Celebrating Safely Under Iowa’s New Fireworks Laws
As we prepare for summer celebrations, many of us are planning backyard gatherings complete with family barbecues and consumer fireworks. However, the legal and insurance landscapes surrounding fireworks in Iowa have recently changed, and crossing the line could put your financial security at risk.
Under Iowa state law (Senate File 303), local cities and counties can no longer completely ban the use of consumer fireworks on July 3rd, July 4th, and New Year’s Eve. While this means you are legally permitted to light fireworks on your own property during designated holiday hours, it does not clear you of financial liability if something goes wrong. At The Hoffman Agency, we want to ensure your holiday celebrations don’t result in a denied insurance claim or an expensive liability lawsuit.
Does Homeowners Insurance Cover Fireworks Damage?
The answer depends entirely on how and where the fireworks were discharged. Your standard Homeowners Insurance policy is built around two primary types of protection: property coverage and liability coverage.
Damage to Your Own Property
If an accidental firework spark lands on your roof or deck and causes a fire, your policy’s dwelling coverage will typically pay to repair the physical damage—assuming you were using legal, consumer-grade fireworks during the state-approved holiday window.
However, if you are caught using illegal display-grade explosives or discharging them outside of the legal hours (such as later in July or past the designated curfew), your insurance company could argue that you engaged in an illegal act or intentional risk. This can lead to a denied property claim, leaving you to pay for your home’s repairs entirely out of pocket.
Liability for Injuries and Neighboring Property
The biggest financial trap involving fireworks is third-party liability. If a bottle rocket veers off-course and strikes a neighbor’s house, or if a guest is injured by a firework on your property, you could face massive legal and medical bills.
- The Permission Rule: Iowa law strictly prohibits discharging fireworks on any property you do not own unless you have explicit consent from the property owner. It is also completely illegal to set them off on city streets, sidewalks, or public parks.
- The Claim Denials: If you violate these boundary laws and cause damage or injury on public property, your home insurance liability coverage may refuse to defend you in court, exposing your personal savings to a civil judgment.
Safety Protocols to Protect Your Home and Guests
To minimize your risk of property damage and ensure compliance with your policy’s safety expectations, always practice these standard precautions:
- Keep a Dedicated Water Source Nearby: Always have a connected garden hose or a fire extinguisher within arm’s reach of the launch zone.
- The “Dud” Policy: Never attempt to re-light or pick up a firework that failed to ignite. Let it sit for 20 minutes, then submerge it completely in a bucket of water.
- Sparkler Safety: Sparklers burn at temperatures exceeding 1,200 degrees Fahrenheit—hot enough to cause third-degree burns instantly. Always supervise children closely and drop used sparklers directly into a bucket of water immediately after use.
- Maintain Distance: Ensure your launch site is at least 35 feet away from residential structures, overhanging trees, and dry brush.
Review Your Liability Limits Before the Holiday
Before you stock up on sparklers and fountains, take a moment to ensure your policy limits are sufficient. If you frequently host large backyard gatherings, we often recommend supplementing your standard home policy with a personal Umbrella Insurance policy. An umbrella policy provides an extra layer of liability protection that kicks in if a catastrophic accident exceeds your home insurance boundaries.
